Terms and conditions

Please read these terms before you play. They are the agreement between you and us, and section 8 in particular explains something that matters: SmoogieDollars and everything else in the game are a licence to use part of a live service, not property you own, and one day Smoogies will stop running.

1. Who we are

Smoogies is operated by Moi! ("Smoogies", "we", "us", "our").

2. What these terms cover

These Terms and Conditions apply to:

  • the Smoogies website at www.smoogies.com, including the forum and the encyclopedia
  • the Smoogies game, whether you play it in a browser at app.smoogies.com or through the Smoogies app
  • your Smoogies account, your saved game, and any purchase you make in the game

We call all of that "the service" below.

Our Privacy Policy explains what we do with your personal data and forms part of these terms.

3. Accepting these terms

By creating an account, by playing, or by posting in the forum, you accept these terms. If you do not accept them, please do not use the service.

We may change these terms, for example when we add features, when a law changes, or when something here turns out to be unclear. We will publish the new version with a new "Last updated" date. If a change is material, and in particular if it affects purchases, we will give notice in the game or by email before it takes effect. If you carry on using the service after that, you accept the new version. If you do not want to, you may stop and close your account.

4. Who may play

You must be 13 or over to use the service.

If you are under 18, you may only use the service with the permission of a parent or guardian, and if you are under 16 that permission is required before an account is created. If you are a parent or guardian and your child is using Smoogies, you are responsible for their use of it, including any purchase made on your device.

You must be able to enter into a binding agreement under the law of the country you live in. If we have good reason to believe an account belongs to somebody below the age limit, we may close it.

5. Your account

You can play as a guest, with no account at all. An account exists so your Smoogies survive losing, replacing or wiping your device. That is what it is for, and nothing in the game is locked behind having one.

  • An account is for one person. Do not share it, sell it, rent it, give it away, or buy somebody else's.
  • Keep your password to yourself. You are responsible for what happens on your account while somebody is signed in to it.
  • Give us a real email address. It is how we reach you about your account, and we cannot help you recover an account we cannot verify.
  • Tell us at support@smoogies.com if you think somebody else has got into your account.

You may delete your account at any time from inside the game. What happens when you do is set out in our Privacy Policy, and it matters: the things that identify you go immediately, and the saved game is kept for 12 months, unattached, so an accidental deletion can still be undone.

Be careful with the Remove login details option on the log out panel. It is not a log out. It destroys the account behind the game on that device, permanently, and the game can then never be recovered anywhere else. An ordinary Log out ends the session on that device only.

6. Names, posts, and anything else you write

You choose your player name and the names of your pets, and you may post in the forum. What you write stays your own, but by submitting it you give us permission to store it, display it to others where that is the point of the feature, and keep it running as part of the service. That permission is free of charge, worldwide, and lasts as long as the content is on the service.

Do not submit anything that is:

  • illegal, or that encourages something illegal
  • hateful, harassing, threatening, or aimed at somebody because of who they are
  • sexual, or otherwise plainly unsuitable for a game whose players include 13-year-olds
  • somebody else's, unless you have the right to post it
  • somebody's personal information, including your own that you would not want made public
  • spam, advertising, or a link posted to drive traffic somewhere

Names are filtered automatically before they are accepted, but no filter catches everything. We may rename a player or a pet, or remove a post, without warning, if it breaks the rules above. We will do that no more than we have to.

Anything you post in the forum is public. It can be read by anyone, and search engines may index it.

7. How you may use the service

Play the game as it is meant to be played. Specifically, do not:

  • use cheats, bots, macros, modified clients, or anything that plays the game for you
  • exploit a bug for gain. If you find one, tell us at support@smoogies.com. We would much rather hear about it than find it in your inventory
  • interfere with the service, its servers or its API, including scraping it, flooding it with requests, or trying to get at data that is not yours
  • attempt to reverse engineer, decompile or disassemble the software, except to the extent the law expressly allows despite this clause
  • sell, trade or advertise accounts, pets, items or SmoogieDollars for real money or anything else of real-world value, anywhere, including outside the game
  • pretend to be us, or another player, or a member of our support team

We may remove items or SmoogieDollars that were obtained through a bug, an exploit, a mistake on our side, or a reversed payment, and we may do so without compensating you for them.

8. Pets, items and SmoogieDollars: what you actually have

This is the section that catches people out in every online game, so it is written plainly.

SmoogieDollars, pets, items, clothing, your home, your garden and your progress are not property and you do not own them. What you have is a limited, personal, non-transferable, revocable licence to use them inside Smoogies for as long as we run Smoogies and your account is in good standing.

It follows that:

  • They have no real-world value. SmoogieDollars are not money, not a payment instrument, not e-money, not a deposit and not a stored-value balance. They cannot be cashed out, exchanged for money, or transferred to another person or account.
  • They cannot be inherited, assigned, or sold, and any attempt to do so is void.
  • They exist only inside the service. If your account ends, or the service ends, they end with it.

We may change the game. We can add, remove, rebalance, reprice or retire pets, species, items, features, quests and prices, and we can change how much SmoogieDollars are earned and what they buy. A game that cannot be balanced cannot be kept fair or kept alive. Changes of this kind do not entitle you to a refund or to compensation, including where something you bought or earned becomes cheaper, rarer, easier to get, or is taken out of the game.

We will not do that carelessly. Our published commitment is that a player who never pays a penny must always be able to feed their pet, complete quests and progress, and we treat that as a rule rather than an aspiration.

9. Purchases

9.1 What is sold

In-app purchases are not available yet. When they are, what is sold is SmoogieDollars, in a small number of clearly priced packs. There are no loot boxes, no random paid eggs, and nothing else with a surprise in it. No purchase is ever required to keep playing.

9.2 Who you are buying from

Purchases are made through Google Play or the Apple App Store, using the payment method held on your account there. That store processes the payment and, in most countries, is the seller for the transaction. Its own terms and privacy policy apply to the payment, and we never see your card, bank or billing details. What reaches us is a record that a pack was bought, so we can credit it.

9.3 Price and tax

The price you see in the store before you confirm is the price you pay, in your own currency, including VAT or local sales tax where it applies. Stores adjust prices per country and from time to time, and currency conversion and any charge from your own bank are between you and them.

9.4 Delivery, and your right of withdrawal

SmoogieDollars are credited to your account immediately after the store confirms the payment.

If you are a consumer in the EU you normally have 14 days to withdraw from a distance purchase. Because this is digital content delivered at once, by buying you ask us to deliver immediately and you acknowledge that you lose that right of withdrawal as soon as delivery begins. The store will ask you to confirm this at the point of purchase.

9.5 Refunds

Because the store takes the payment, the store handles refunds under its own policy, and that is the first place to ask. We cannot reverse a charge we never received. Where we can help, we will: write to support@smoogies.com and we will support a reasonable request to the store as far as we are able.

Apart from your statutory rights, and outside the store's own refund policy, we do not give refunds for:

  • SmoogieDollars you have already spent, or items you no longer want
  • a change to the game's balance, prices, content or features
  • an account you deleted, or one we closed because these terms were broken
  • progress, items or SmoogieDollars lost through a device being lost, wiped or replaced while you were playing without an account
  • the service closing down (see section 10)

If somebody else, a child for instance, made a purchase on your device, contact the store: both Google and Apple have a process for that, and both offer parental controls and purchase passwords that prevent it happening again. Tell us as well and we will help where we can.

Nothing in this section limits the rights you have as a consumer under the mandatory law of the country you live in. Where something here conflicts with those rights, those rights win.

9.6 Chargebacks

If a payment is reversed or charged back after the SmoogieDollars have been credited, we may remove those SmoogieDollars, and anything bought with them, and we may suspend the account until the matter is settled.

10. Availability, changes, and the day Smoogies closes

10.1 Availability

The service is provided as it is and as available. We work hard to keep it up, but we do not promise it will be uninterrupted or error free. It needs maintenance, it will occasionally break, and some parts of it need an internet connection to sync even though the game is built to keep playing without one.

We back up our servers and we take care of your saved game, but no backup is perfect and we cannot guarantee that saved data is never lost. Data held on your own device is your device's responsibility.

10.2 We may change or withdraw features

We may change, suspend or withdraw any part of the service. Where a change is significant and we can see it coming, we will say so in advance.

10.3 If Smoogies shuts down

Smoogies is a live online service, and one day it will stop. That may be because it is no longer sustainable to run, or for any other reason. It is better that you know now what that means than find out then.

What we promise if we close the service:

  • We will give at least 30 days' notice, on the website and in the game, wherever it is within our power to do so.
  • We will stop selling SmoogieDollars on the day we announce it, so that nobody buys a pack into a service that is closing.
  • We will do what we reasonably can, in that window, to let you enjoy or spend what you have.

What happens on the closing day:

  • Accounts, saved games, pets, items, homes, gardens, progress and any unspent SmoogieDollars cease to exist, and cannot be restored afterwards.
  • There is no refund and no compensation for unspent SmoogieDollars, for SmoogieDollars that were bought, for items, for pets, or for the time you spent playing.

That is the direct consequence of section 8. What you bought was the use of a feature of a running service, not a balance we hold for you, and the notice period above is what makes that fair rather than a trap. Your statutory rights as a consumer are unaffected, and if mandatory law where you live requires otherwise in your case, that law applies.

11. Suspending or closing an account

We may suspend or close an account, remove content, or withdraw access, where we reasonably believe that these terms have been broken, that the service is being cheated or attacked, that a payment is fraudulent, or that we are required to by law.

Where it is reasonable to do so we will tell you why and give you a chance to put it right, and we will keep the response in proportion to what happened. A closure for breach does not entitle you to a refund of anything bought or earned.

You may close your own account at any time, as described in section 5.

12. Pets from the old Smoogies website

If you played Smoogies before, you may be able to claim one pet from your old account into the new game. That is a courtesy, offered for a limited period, and it has limits worth stating: one pet per person, the claim depends on the old record still existing, and old records are destroyed automatically 12 months after they were imported. A claimed pet arrives with its original birth date and is otherwise an ordinary pet in the new game, subject to these terms like any other.

What we hold from the old site, and for how long, is set out in the Privacy Policy.

13. Our intellectual property

Smoogies, the Smoogies name and logo, the species and their names, the artwork, models, music, sound, text, maps and software are owned by Moi! or licensed to us, and are protected by copyright and other rights. These terms give you permission to use them in order to play the game, and nothing more.

You are welcome to take screenshots and record or stream your play, and to share them, including on a channel that earns you money. What you may not do is sell our assets, pass our work off as yours, use the Smoogies name or logo in a way that suggests we endorse you, or build a product out of our material.

14. App stores

Where you install the Smoogies app from Google Play or the Apple App Store, that store's own terms apply to the download and to any purchase made through it.

For the Apple App Store specifically: this agreement is between you and Moi! only, and not with Apple. Apple is not responsible for the app or its content. Apple has no obligation to provide any maintenance or support for it, and support requests should go to us at support@smoogies.com. Apple is not responsible for addressing any claim you have about the app, including product liability, any claim that it fails to conform to a legal requirement, or any claim under consumer protection or privacy law. If a third party claims the app infringes their intellectual property, Apple is not responsible for investigating or resolving it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

15. Third-party services and links

The service relies on providers such as our host, the app stores and the payment systems inside them, and the website may link to places we do not run. We are not responsible for third-party services or sites, and their own terms and privacy policies apply when you use them.

16. Our liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be excluded or limited under Dutch law. If you are a consumer, nothing here takes away the rights that mandatory consumer law gives you.

Subject to that:

  • We are not liable for indirect or consequential loss, for loss of profit, or for loss of an opportunity.
  • We are not liable for lost progress, lost pets, lost items or lost SmoogieDollars, however caused, except where we are at fault and the law does not allow us to exclude it.
  • We are not liable for interruptions, downtime, or anything caused by your device, your connection, or a third party.
  • Where we are liable, our total liability to you for all claims in any 12-month period is limited to the greater of the amount you paid us, directly or through an app store, for Smoogies in that period, or 50 euro.

Smoogies is entertainment. Please do not rely on it for anything that matters.

17. Force majeure

We are not responsible for failing to provide the service where that is caused by something outside our reasonable control, including network or hosting failures, power cuts, attacks on our infrastructure, changes in the law, or the withdrawal of a service we depend on.

18. Complaints and disputes

If something has gone wrong, write to support@smoogies.com first. We read everything sent to that address and we aim to reply within 14 days. Most things are settled there, and we would rather settle them there.

19. Governing law and jurisdiction

These terms are governed by the law of the Netherlands.

Disputes may be brought before the competent court in the Netherlands. If you are a consumer living in another EU country, you keep the protection of the mandatory rules of your own country's law, and you may also bring proceedings in the courts there.

20. The rest

  • If any part of these terms turns out to be unenforceable, the rest stays in force, and the unenforceable part is replaced by one that is valid and comes as close as possible to what was intended.
  • If we do not enforce something straight away, we have not given up the right to enforce it later.
  • These terms, together with the Privacy Policy, are the whole agreement between you and us about the service.
  • You may not transfer your rights under these terms to anybody else. We may transfer ours if Smoogies is transferred to another operator, and if that happens we will tell you first, and your account and these terms carry over.
  • These terms are published in English. Where we publish a translation and the two disagree, the English version applies.
